Capitalism describes the behavior of capital (money) when left to its own devices.
Any government regulation that does anything other than inform the public is NOT capitalism. Pro-capitalistic regulation would be something like weights and measures, it informs by governing a system of common measurement preventing deception.
The most capitalistic systems are the ones found in the most lawless regions.
The private prison industry has promoted policies and practices that increase the number of people who enter and stay incarcerated that are profit driven and have nothng to do with justice let alone rehabilitation.
